dc.description | A Constituição da República Federativa do Brasil de 1988 positivou a saúde como direito de todos e dever do Estado, garantido mediante a adoção de políticas sociais e econômicas que reduzam o risco doença e outros agravos. O objetivo deste trabalho consistiu em averiguar como o Poder Judiciário tem enfrentado o tema do direito à saúde. A pesquisa realizada pelo INSPER, encomendada pelo Conselho Nacional de Justiça demonstra que a maior parte da de-manda está centrada no fornecimento de medicamentos e insumos. A atuação do Poder Judiciá-rio reduz o conceito de saúde à simples ausência de doença, contrariando os conceitos mais am-plos adotados por agências nacionais e internacionais de saúde. Foi realizado estudo sobre os determinantes sociais da saúde, adotados pela Organização Mundial da Saúde, identificando que, sem mudanças profundas na estrutura da sociedade não haverá garantia do direito à saúde, pois este só pode ser efetivamente implementado mediante adoção de políticas sociais e econômicas que reduzam o risco de doença, eliminando as iniquidades nos acessos aos bens e serviços em saúde. | |
dc.description | The Constitution of the Federative Republic of Brazil of 1988 positified health as a right of all and a duty of the State, guaranteed through the adoption of social and economic policies that reduce the risk of disease and other diseases. The objective of this work was to find out how the Judiciary has faced the issue of the right to health. The research carried out by INPER, commissioned by the National Council of Justice, showed that most of the demand is centered on the supply of medicines and supplies. The role of the Judiciary Branch reduces the concept of health to the simple absence of disease, contradicting the broader concepts adopted by na-tional and international health agencies. A study was carried out on the social determinants of health, adopted by the World Health Organization, identifying that, without profound changes in the structure of society, there will be no guarantee of the right to health, as this can only be effectively implemented through the adoption of policies social and economic factors that re-duce the risk of disease, eliminating inequities in access to health goods and services. | |
