dc.description.abstract | La pandemia del Covid-19 impacto directamente los proyectos de Asociación Publico-Privada (APP) a nivel mundial, influyendo a nivel contractual en estos proyectos. En consecuencia, diferentes proyectos fueron renegociados en busca de condiciones favorables para las partes. Por esta razón, este estudio busca desentrañar los mecanismos contractuales implementados o afectados en las renegociaciones causadas por el Covid-19 en los proyectos APP en Colombia. Así se espera determinar los impactos de la pandemia y las estrategias contractuales implementadas en los diferentes procesos de renegociación. Para esto se realizó un análisis, individual y por conjuntos, de los mecanismos contractuales. El análisis estará soportado por las metodologías de análisis de contenido (CA), procesamiento de lenguaje natural (NLP) y análisis de redes sociales (SNA) para realizar el análisis individual y por grupos, respectivamente. Por medio de estas metodologías fue posible clasificar cada mecanismo contractual para su posterior análisis en red, donde se encontraron diferentes impactos y estrategias comunes entre procesos de renegociación. La investigación determinó las principales afectaciones y estrategias del Covid-19 en proyectos APP en Colombia, un entendimiento holístico de los procesos de renegociación y se estableció una metodología que ayude al análisis contractual y de posteriores procesos de renegociación. | |
