El agua y la producción del hidrógeno desde una perspectiva ambiental

Abstract

En el presente artículo, se realiza un análisis con aspectos jurídicos y técnicos, relativos a la utilización del denominado “hidrógeno verde”, el cual está siendo impulsado como un vector clave en la transición energética mundial. Se inicia el mismo desarrollando diversos aspectos técnicos para su obtención, haciendo énfasis en que el insumo primordial es el “agua”. Por otra parte, se realiza una revisión general de los avances que se han tenido en México respecto a su regulación y puesta en marcha. Se destina un capítulo al estudio de dos de los principales temas ambientales que están vinculados a la producción de este tipo de hidrógeno: (i) el primero, relacionado con los problemas de utilización del recurso hídrico en zonas donde actualmente hay escasez; y, (ii) el segundo, conectado con los posibles impactos indirectos que agravarían las consecuencias del fenómeno del cambio climático. Finalmente, se resalta la necesitada de realizar más estudios científicos al respecto y aplicar el principio precautorio, para así poder emitir los marcos normativos que permitan prevenir afectaciones ambientales y sociales. Lo anterior, ayudará además a impulsar la protección de los derechos humanos.

In this article, an analysis is carried out with legal and technical aspects, related to the use of the so-called "green hydrogen", which is being promoted as a key vector in the global energy transition. It begins by developing various technical aspects to obtain it, emphasizing that the primary feedstock is "water". On the other hand, a general review of the progress that has been made in Mexico regarding its regulation and implementation is carried out. A chapter is dedicated to the study of two of the main environmental issues that are linked to the production of this type of hydrogen: (i) the first, related to the problems of using water resources in areas where there is currently a shortage; and, (ii) the second, connected with the possible indirect impacts that would aggravate the consequences of the climate change phenomenon. Finally, the need to carry out more scientific studies in this regard and apply the precautionary principle is highlighted, in order to issue the regulatory frameworks that will prevent environmental and social damages. This will also help promote the protection of human rights.
