Integración de los Conductores del Servicio Público de Taxi al Sistema de Seguridad Social en San José de Cúcuta

Abstract

En este proyecto de investigación se buscó llevar a cabo un análisis integral de la situación de los conductores de taxi frente a la materialización del derecho a la seguridad social, teniendo en cuenta a aquellos que se encuentran en San José de Cúcuta. Este estudio está impulsado desde el enfoque cualitativo y desde la tipología descriptiva.

Esas bases metodológicas, las cuales fueron complementadas con las técnicas denominadas análisis documental y entrevista, se desarrollaron unos resultados basados en reconocer cómo está compuesto el marco jurídico que regula la integración de los conductores del servicio público de taxi al Sistema de Seguridad Social, además de establecer qué dice la doctrina teniendo presente que existe un contrato individual de trabajo, un conductor que funge como trabajador independiente y uno que es contratista. De igual modo, se identificaron los conceptos de los líderes de este gremio en Cúcuta sobre el alcance del derecho a la seguridad social para ellos.

Según los entrevistados, la normatividad que regula las generalidades sobre el acceso al derecho a la seguridad social no tiene en cuenta las características especiales que posee el oficio de ser taxista; es decir, no se encuentran debidamente delimitadas las situaciones relacionadas con la vinculación al Sistema General de Seguridad Social (contrato individual de trabajo, contratista y trabajador independiente).

Por ese motivo, se sugirió tanto las entidades municipales, las empresas de servicio público de transporte terrestre en vehículos tipo taxi y los representantes del Gobierno Nacional puedan realizar un análisis más profundo sobre el alcance del derecho a la seguridad social en ese ámbito y así evaluar las causas que llevan a que no se produzca una plena integración al Sistema General de Seguridad Social. Contando con datos más puntuales será posible fundamentar conversaciones con mejores argumentos y con soluciones más factibles.
