O Sociologismo Francês e o Pensamento Jurídico de Nestor Duarte: A Sociologia Jurídica na FDUFBA

Abstract

O tema desta monografia é a influência do sociologismo francês no pensamento jurídico de Nestor Duarte. O objetivo principal é demonstrar a implicação do ideal sociológico na construção do conceito de Direito, na concepção do indigitado autor, reacendendo o debate sobre a importância de se estudar sociologia. Autores como Durkheim e León Duguit, principais expoentes do pensamento sociológico da França e suas doutrinas, são identificados no decorrer da produção intelectual de Nestor Duarte, tais como O Direito: Noção e Norma (1933) e Gado Humano (1936), principalmente. Entretanto, antes de adentrar ao pensamento de Nestor Duarte, foi percebida a necessidade de expor o pensamento individualizado dos intelectuais franceses, para que fosse permitida uma compreensão mais precisa da discussão. Além dessa exposição sumária, outras anotações consideradas fundamentais para o nascimento da preocupação teórica da antiga Faculdade de Direito da Bahia, atualmente Faculdade de Direito da Universidade Federal da Bahia, assinalando o influxo recebido pelas escolas de São Paulo e Recife, pontuando os autores mais destacados, é o caso de Silvio Romero e Tobias Barreto, e de um dos autores mais importantes do pensamento sociológico, que embora não possua suas raízes teóricas no pensamento Francês, desenvolveu um trabalho científico-sociológico excepcional, falamos de Almachio Diniz. Ao discorrer sobre Duarte e sociedade, foi feita a análise mais próxima possível das ideias que o autor apresenta explícita e implicitamente em sua produção bibliográfica. Todo o exame e as constatações provenientes deste foram realizados através das obras e de textos selecionados, cuja metodologia situa-se na Revisão de Literatura e o dedutivo. Procurou-se, a partir do pensamento social do fenômeno jurídico, demonstrar a relevância atual da ciência conhecida por Sociologia, pois, como ficará demonstrado no desenvolvimento deste trabalho, tudo o que conhecemos, bom ou ruim, derivou da trama coletiva, pois antes de ser institucional qualquer aspecto vem a surgir, aqui inclui-se o direito, já povoava as mentes dos indivíduos socialmente considerados.

The theme of this monograph is the influence of French sociologists on Nestor Duarte's legal thinking. The main objective is to demonstrate the implication of the sociological ideal in the construction of the concept of Law, in the conception of the author, reacting the debate about the importance of studying sociology. Authors like Durkheim and Leon Dugui, the main exponents of sociological thought of France, and their doctrines are identified in the course of the intellectual production of Nestor Duarte, such as Law: Notion and Norma (1933) and Human Cattle (1936), mainly. However, before entering the thinking of Nestor Duarte, the need to expose the individualized thinking of the French intellectuals was perceived, so that a more precise understanding of the discussion was allowed. In addition to this summary, other notes considered fundamental for the birth of the theoretical concern of the former Faculty of Law of Bahia, currently the Faculty of Law of the Federal University of Bahia, pointing out the influx received by the schools of São Paulo and Recife, highlighting the most outstanding authors , is the case of Silvio Romero and Tobias Barreto, and one of the most important authors of sociological thought, which although it does not have its theoretical roots in French thought, has developed an exceptional scientific-sociological work, we speak of Almachio Diniz. In discussing Duarte and society, a closer analysis was made of the ideas that the author presents explicitly and implicitly in his bibliographic production. All the examination and the findings from this were done through the works and selected texts, whose methodology is in the Literature Review and the deductive. From the social thought of the juridical phenomenon, it was tried to demonstrate the current relevance of the science known as Sociology, because, as will be demonstrated in the development of this work, everything we know, good or bad, derived from the collective plot, being institutional any aspect comes to arise, here includes the right, already populated the minds of socially considered individuals.
