A Responsabilidade Compartilhada para proteção Internacional de Refugiados à Luz da Declaração de Nova Iorque

Abstract

O presente trabalho tem por finalidade examinar a Declaração de Nova Iorque sobre Refugiados e Migrantes e compreender se esta estabelece uma obrigação de compartilhamento de responsabilidades entre Estados para a proteção de refugiados. Para tanto, foi realizada uma pesquisa sobre o atual regime internacional de proteção de refugiados, fundado na Convenção de 1951 Relativa ao Estatuto de Refugiados e seu Protocolo Adicional de 1967, e complementado pelas normas de Direito Internacional dos Direitos Humanos e Direito Internacional Humanitário, bem como por outros instrumentos regionais relevantes. Analisando o contexto da criação da Declaração de Nova Iorque, caracterizado por um número sem precedentes de pessoas em deslocamento, restou-se evidente a necessidade de adoção de uma abordagem abrangente por parte dos Estados, pautada no compartilhamento de responsabilidades para melhor responder aos grandes movimentos de refugiados. Desse modo, foram analisados os (i) compromissos previstos na Declaração; (ii) o Quadro Abrangente de Respostas para Refugiados – CRRF, anexo à Declaração e (iii) a proposta de um Pacto Global sobre Refugiados, também prevista pela Declaração. Ademais, foi examinado o princípio da responsabilidade compartilhada, visando compreender o significado do termo, a sua natureza e os desafios para a sua implementação prática. Posteriormente, foram analisados exemplos práticos de mecanismos de responsabilidade compartilhada adotados por Estados. Por fim, cumpriu-se verificar se o Pacto Global sobre Refugiados traduz um compromisso prático de concretização da responsabilidade compartilhada entre Estados para proteção de refugiados.

This work aims to analyse the New York Declaration for Refugees and Migrants and understand whether it foreseen an obligation of responsibility-sharing among States for refugee protection. For this purpose, it was conducted a research on the current international refugee regime, groundend in the 1951 Convention relating to the Status of Refugees and its 1967 Protocol and complemented by International Human Rights Law and International Humanitarian Law, as well as other regional relevant instruments. By analyzing the contexto in which the New York Declaration was created, characterized by an unprecedented number of people on the move, it was evident the need of States apdopting a coprehensive approach, based on the responsibility-sharing to better address the large movements of refugees. Therefore, it was analyzed: (i) the commitments foreseen in the Declaration; (ii) the Comprehensive Refugee Response Framework – CRRF, annex of the Declaration; and (iii) the proposal of a Global Compact for Refugees, also foreseen in the Declaration. Moreover, it was examined the principle of responsibility-sharing, aiming to understand the meaning of the term, the narture and the challenges for its practical implementation. Later, examples of practical mechanisms of responsibility-sharing among States were analyzed. Finally, it was verified whether the Global Compact for Refugees embodies a practical commitment to the achievement of shared responsibility among States for refugees protection
