| dc.description | The present work had the general objective of analyzing the concept of structural racism present in the Inter-American Convention against Racism (OAS, 2013) and in the specialized bibliography, as in the work of Djamila Ribeiro and Sílvio Almeida. First, the methodological parameters were established. A narrative-type literature review was chosen. Narrative review articles are broad publications, suitable for describing and discussing the development or “state of the art” of a topic to be researched, from a theoretical, historical or contextual point of view. Then, three Conventions relevant to the topic were explained, that is, the International Convention to Combat Racism (1965), the International Convention on the Elimination of All Forms of Discrimination against Women (1979) and the Inter-American Convention against Racism. , racial discrimination and related forms of intolerance (2013). Next, the impact of these Conventions on national law is demonstrated, in addition to the STF's proactive action, in the realization of these rights, from 2003 to 2019, its main decisions. Finally, the concept of structural racism present in the Inter-American Convention against racism and in the thematic bibliography, as being “a set of practices, habits, situations and speeches present in the daily life of the population that, even without racial intention, , promotes racism. It consists of any theory, doctrine, ideology or set of ideas that state a causal link between the phenotypic or genotypic characteristics of individuals or groups and their intellectual, cultural and personality traits, including the false concept of racial superiority.” | |
| dc.description | O presente trabalho teve por objetivo geral analisar o conceito de racismo estrutural presente na Convenção interamericana contra o racismo (OEA, 2013) e na bibliografia especializada, como na obra de Djamila Ribeiro e de Sílvio Almeida. Em primeiro lugar, estabeleceu-se os parâmetros metodológicos. Optou-se por uma revisão bibliográfica do tipo narrativa. Os artigos de revisão narrativa são publicações amplas, apropriadas para descrever e discutir o desenvolvimento ou o “estado da arte” de um tema a ser pesquisado, sob ponto de vista teórico, histórico ou contextual. Em seguida, foram explicitadas três Convenções pertinentes ao tema, ou seja, a Convenção internacional de combate ao racismo (1965), a Convenção internacional sobre a eliminação de todas as formas de discriminação contra a Mulher (1979) e a Convenção interamericano contra o racismo, a discriminação racial e formas correlatas de intolerância (2013). Na sequência, demonstra-se o impacto dessas Convenções no direito pátrio, além da atuação proativa do STF, na efetivação desses direitos, de 2003 a 2019, as suas principais decisões. Por fim, o conceito de racismo estrutural presente na Convenção interamericana contra o racismo e na bibliografia temática, como sendo “um conjunto de práticas, hábitos, situações e falas presentes no dia-a-dia da população que, mesmo que sem a intenção racial, promove o racismo. Consiste em qualquer teoria, doutrina, ideologia ou conjunto de ideias que enunciam um vínculo causal entre as características fenotípicas ou genotípicas de indivíduos ou grupos e seus traços intelectuais, culturais e de personalidade, inclusive o falso conceito de superioridade racial.” | |
