| dc.description | The present research was developed in the the Master's Degree Program in Applied
Social Sciences at the Universidade Estadual de Ponta Grossa (UEPG), with the
objective of analyzing the execution of socio-educational measures in an open
environment in the city of Guarapuava/PR. With this in mind, through the Case Study,
an incursion into the research field was carried out for an approximation to the reality
experienced by professionals who work directly in the planning, execution and
monitoring of socio-educational measures. During this journey, documents, data on
infractions and the respective measures imposed by the Judiciary were analyzed. In
that regard, semi-structured interviews were carried out with the technical team and
social advisors. The analysis of the research data was carried out in the light of the
theoretical basis of critical criminology, in order to understand the infraction as a social
phenomenon, product of a political and economic model. In the introduction of the work
presents the purposes of the study and the research methodology; In chapter 2, a
documental analysis was carried out on the differentiated treatment of the Brazilian
State in relation to the adolescent who committed an infraction, from the first
Constitution of the Empire of Brazil in 1824 to the structuring of a Socio-educational
System proposed by Law nº 12.594/2012, showing how the political, economic and
social conjuncture influenced the direction of the State response to this question; In
chapter 3, the analysis of the infractions committed by adolescents who live in
Guarapuava on the period from 2011 to 2019 was carried out, which were obtained
from the database of the electronic process system (Projudi) of the Vara da Infância e
Juventude of the District of Guarapuava/PR , as well as the sociodemographic data of
the city of Gurarapuava/PR, in comparison with the State of Paraná and Brazil. In
chapter 4, we sought to understand the challenges and difficulties experienced by the
team of professionals who work with adolescents in compliance with the socioeducational measure in an open environment. From the analysis carried out, it is
concluded that the socio-educational measures, over the years, were used as an
instrument of social control of adolescents in situations of vulnerability, marked by the
process of institutionalization and criminalization of poverty; that the socio-educational
system, as well as the penal system, reproduces the selectivity and stigmatization of
its public; and that the application of socio-educational measures, as they are being
carried out, are not enough to break the cycle of deprivation and violations of rights
previously experienced by adolescents in situations of conflict with the law. | |
| dc.description | A presente pesquisa foi desenvolvida no âmbito do mestrado em Ciências Sociais
Aplicadas da Universidade Estadual de Ponta Grossa (UEPG), com objetivo de
analisar a execução das medidas socioeducativas em meio aberto no município de
Guarapuava/PR. Com este intuito, por meio do Estudo de Caso, realizou-se a incursão
no campo de pesquisa para uma aproximação à realidade vivenciada pelos
profissionais que trabalham diretamente no planejamento, execução e
acompanhamento das medidas socioeducativas. Durante este percurso foram
analisados documentos, dados sobre os atos infracionais e as respectivas medidas
impostas pelo Poder Judiciário e realizadas entrevistas semiestruturadas com a
equipe técnica e orientadores sociais. A análise dos dados da pesquisa foi realizada
à luz da base teórica da criminologia crítica, em razão de compreender o ato
infracional como um fenômeno social, produto de um modelo político e econômico. Na
introdução do trabalho apresentam-se os propósitos do estudo e a metodologia de
pesquisa; no capítulo 2 foi realizada a análise documental sobre o tratamento
diferenciado do Estado brasileiro em relação ao adolescente autor de ato infracional,
desde a primeira Constituição do Brasil Império em 1824 até a estruturação de um
Sistema Socioeducativo proposto pela Lei nº 12.594/2012, evidenciando-se como a
conjuntura política, econômica e social influenciou os rumos da resposta estatal a esta
questão; no capítulo 3 realizou-se a análise dos atos infracionais praticados pelos
adolescentes guarapuavanos no período de 2011 a 2019, os quais foram obtidos pela
base de dados do sistema de processos eletrônicos (Projudi) da Vara da Infância e
Juventude da Comarca de Guarapuava/PR, bem como foram apurados os dados
sociodemográficos da cidade de Gurarapuava/PR, em cotejo com o Estado do Paraná
e do Brasil; no capítulo 4 buscou-se compreender os desafios e dificuldades
vivenciados pela equipe de profissionais que trabalham com os adolescentes em
cumprimento da medida socioeducativa em meio aberto. A partir das análises
realizadas conclui-se que as medidas socioeducativas, ao longo dos anos, foram
utilizadas como instrumento de controle social dos adolescentes em situação de
vulnerabilidade, marcado pelo processo de institucionalização e de criminalização da
pobreza; que o sistema socioeducativo, assim como o sistema penal, reproduz a
seletividade e estigmatização do seu público; e que a aplicação das medidas
socioeducativas, da forma com que estão sendo executadas, não são suficientes para
romper com ciclo de privações e violações de direitos previamente vivenciadas pelos
adolescente situação de conflito com a lei. | |
