La reformulación del derecho a la privacidad y el reconocimiento de los nuevos derechos en el entorno digital en tiempos de covid-19

Abstract

El presente artículo consiste en analizar el significado del derecho a la privacidad en la sociedad del siglo XXI y el reconocimiento de los nuevos derechos en la era digital. A tales efectos, comprende tres partes: la primera delimita el marco contextual, la segunda desarrolla el derecho a la privacidad y su protección jurídica y la tercera identifica y analiza los nuevos derechos en el entorno digital en tiempos del COVID-19.

The notorious increase of the Internet and social networks has generated a scenario in which more and more personal data is collected, stored and analyzed, even generating new data from this treatment, that are totally unknown by the interested party. The data are beginning to be used and reused for the most diverse purposes, many of which can be harmful to the owner. Therefore, it is necessary to update the meaning of the right to privacy in a digital economy, in which the protection of personal data has become a fundamental piece, as well as to provide a comprehensive and protective legal framework in times of COVID-19.
