La vida como daño en Colombia : responsabilidad civil por uso de esperma equivocada en casos de reproducción asistida

Abstract

This paper addresses the ad hoc lex artis that must be followed in assisted reproduction procedures -artificial insemination, in vitro fertilisation, intracytoplasmic injection-, identifying the possible risks inherent to these methods, identified by medical science. Subsequently, some judgments from other jurisdictions will be analyzed, which have given varied arguments as to whether it is possible to consider life as a damage, and the consequent compensation for damages arising from defective conception and contraception procedures. Finally, the current applicable criteria of medical civil liability -contractual- in Colombia will be identified, which will allow an eventual declaration of civil liability.
