| dc.description.abstract | Taking as a starting point to begging, for one side some lawsuits that many citizens have
been requesting the unilateral divorce due to different arguments, even though this have been
solved by the Constitutional Colombian Court always in a negative way on its judgments C-394
of 2017, C-134 of 2019, C-135 of 2019 and C-589 of 2019. On the other hand, the last laws
projects that The Colombian Republic Congress has been processed to admit the “free divorce” in
Colombia, the first of them was rejected and the other one, it has been on debate. This thesis
proposes to make a comparative law study between Argentina and Spain with the aim of exploring
the precedents, the implementation, and the negative and positive legal effects that unilateral
divorce has caused in their legislation. | |
