La transacción extrajudicial constituye Título Ejecutivo o de ejecución en la comunidad jurídica y legislación Ecuatoriana, 2022 -2023.

Abstract

Este trabajo de investigación se enfoca en la confusión que se genera la Transacción Extrajudicial al considerarla como título ejecutivo y de ejecución a la vez dentro del COGEP, siendo estos distintos procedimientos y en que afecta a la comunidad jurídica y legislación ecuatoriana. Nosotros podemos determinar sin miedo a equivocarnos de que la transacción extrajudicial debe ser considerada como título de ejecución, debido a que su estructura refiere que se realiza sin mediar juicio alguno. Muy diferente de un título ejecutivo, que se lo realiza de manera oral por medio de un juzgador para que la obligación sea exigible. Por lo tanto, no constituiría un título ejecutivo si no, uno meramente de ejecución. Para este caso nosotros consideramos que no se debería eliminar, más bien, se lo debería reformular estipulándolo como transacción de manera general como está en el Código Civil para evitar confusiones procesales.

This research work focuses on the confusion that the Extrajudicial Settlement generates when considering it as an executive and execution title at the same time within the COGEP, these being different procedures and how it affects the legal community and Ecuadorian legislation. We can determine without fear of being wrong that the out-ofcourt transaction should be considered as a title of execution, since its structure refers to the fact that it is carried out without any trial. Very different from an executive title, which is done orally by a judge so that the obligation is enforceable. Therefore, it would not constitute an executive title if not, a merely execution one. In this case, we consider that it should not be eliminated, rather, it should be reformulated, stipulating it as a transaction in a general way as it is in the Civil Code to avoid procedural confusion.
