| dc.description | La presente investigación tuvo como objetivo general proponer la modificación de la ley
notarial vinculada de manera directa al nombramiento de curador especial para contraer
segundas nupcias, es este sentido es importante destacar que se realizó un análisis de la
figura del curador para contraer segundas nupcias, se demostraron las ventajas que
constituiría para el sistema de justicia y las partes que el nombramiento del curador
especial para contraer segundas nupcias se efectuara en sede notarial y se efectuó una
propuesta detallada acerca de la necesidad que existe en la actualidad de modificar la ley
notarial en relación al nombramiento de curador especial para contraer segundas nupcias.
La metodología estuvo sustentada en el enfoque mixto, para ello se utilizó el enfoque
cuantitativo al momento de efectuar los análisis estadísticos de las preguntas de las
encuestas aplicadas, así como también se aplicó el enfoque cualitativo al analizar las
entrevistas efectuadas a profundidad y al momento de analizar la normativa contemplada
en la Ley notarial relativa a las funciones del notario. Los resultados de la investigación
demostraron la pertinencia de trasladar ciertas competencias de la jurisdicción voluntarias
a la sede notarial donde destaca el procedimiento para designar curador para contraer
segundas nupcias. La investigación demostró mediante sus resultados que el
nombramiento del curador especial para contraer segundas nupcias efectuado en sede
notarial sería beneficioso para el solicitante ya que se realizaría de una forma más
expedita ya que en sede judicial el trámite puede tardar aproximadamente un mes mientras
que en sede notarial se efectuaría en un día. | |

law in relation to the appointment of a special curator to contract second marriages, for

its results that the appointment of the special curator to contract second marriages carried
out in a notarial office would be beneficial for the applicant since it would be carried out
in a more expeditious way since in a court of law the process can take approximately one
