| dc.description | El Derecho Procesal Penal ecuatoriano entró al siglo XXI con una legislación
desordenada y dispersa, pero concienciado de adaptarse al sistema constitucionalista que
viste el Derecho Internacional, abrió camino con una Constitución en el 2008 que aseguró
el ejercicio de los derechos y garantías de los ciudadanos inmersos en un procedimiento,
penal en el objeto de la presente investigación, perfeccionó el Debido Proceso como una
guía de uso jurisdiccional, irrigando su espíritu de ley a las legislaciones civil y penal, que
evolucionaron en la cohesión de los elementos formales, procesales y del poder punitivo
en un mismo código, la rama penal legisló el Código Orgánico Integral Penal, que
impulsado por el espíritu de proporcionalidad entre el acto típico y la pena consecuente,
así como de celeridad, plasmó en su articulado el Procedimiento Directo, y como
herramienta de investigación en contra del crimen organizado, y dio vida a la técnica de
la Cooperación Eficaz, sin embargo, al parecer la juventud de un sistema inédito en
muchos sentidos, da muestras de aún tener elementos dispersos e incompatibles, tales
como el Procedimiento Directo, que por su corto tiempo de duración, imposibilita la
aplicación de la Cooperación Eficaz, a pesar de que la legislación no lo prohíbe ni señala
tal incompatibilidad, esto, contraría el Derecho al Debido Proceso del accionado, asunto
que se subsana con una reforma en la norma penal, COIP, Artículo 640, otorgando un
rango de treinta hasta noventa días de extensión cuando se aplica la Cooperación Eficaz;
