dc.description | Esta investigación analiza la problemática resuelta por la Corte Constitucional
para comprender y explicar los criterios empleados por este organismo para
determinar que la carga de la prueba en los delitos de receptación le corresponde a
quien realiza la acusación sobre la comisión de este tipo penal. En efecto, se presenta
una problemática de derecho constitucional donde se trata de entender cómo
anteriormente la carga de la prueba asumida por el procesado en el delito de
receptación vulneraba al principio de presunción de inocencia, lo que evidentemente
requiere ser analizado para reconocer cómo la justicia a nivel constitucional es capaz
de reivindicar principios constitucionales como el mencionado para fortalecer la
tutela efectiva de garantías procesales que se encuentran obviadas a la luz del
constitucionalismo. Es así, que el objetivo de esta investigación se centra en el
estudio, análisis y descripción de la inversión de la carga de la prueba en el delito de
receptación según los criterios que se aportan en la revisión de casos a nivel
constitucional y procesal penal. En cuanto a la metodología de la investigación se
realizó un estudio cualitativo y de observación documental donde la doctrina, las
normas jurídicas y la revisión de casos prácticos permite reconocer la inversión de la
carga de la prueba en el delito de receptación. Por consiguiente, los resultados del
proceso investigativo demuestran que la inversión de la carga de la prueba por la
Fiscalía General del Estado contribuye a garantizar la presunción de inocencia como
parte del debido proceso. | |
dc.description | This investigation analyzes the problems resolved by the Constitutional Court
to understand and explain the criteria used by this body to determine that the burden
of proof in reception crimes corresponds to the person who makes the accusation
about the commission of this criminal type. Indeed, a problem of constitutional law is
presented where it is tried to understand how previously the burden of proof assumed
by the accused in the crime of reception violated the principle of presumption of
innocence, which obviously requires analysis to recognize how justice At the
constitutional level, it is capable of vindicating constitutional principles such as the
one mentioned to strengthen the effective protection of procedural guarantees that are
ignored in the light of constitutionalism. Thus, the objective of this research focuses
on the study, analysis and description of the reversal of the burden of proof in the
crime of reception according to the criteria provided in the review of cases at the
constitutional and criminal procedural level. Regarding the methodology of the
investigation, a qualitative and documentary observation study was carried out where
the doctrine, the legal norms and the review of practical cases allow recognizing the
inversion of the burden of proof in the crime of reception. Consequently, the results
of the investigative process demonstrate that the reversal of the burden of proof by
the State Attorney General's Office contributes to guaranteeing the presumption of
innocence as part of due process. | |
