| dc.description | Trabajo de titulación “Exoneración del Pago de pensiones alimenticias a
persona con discapacidad por ser parte del Grupo Vulnerable”, es orientado a
buscar una solución justa y viable que garantice los derechos de la norma
constitucional primeramente al menor de edad con el derecho de recibir
alimentos, y segundo al obligado a prestar alimentos que se encuentren en
posición de doble vulnerabilidad, por ende, imposibilitado de poder cumplir con
la obligación impuesta de alimentos para con sus descendientes.
Problemática evidenciada y verificada mediante la investigación doctrinaria y
legal, de igual manera a través del estudio de campo; que en resumen resulta
imperante que se regule a esta clase de situación en el artículo 5, Título V, del
Código Orgánico de la Niñez y de la Adolescencia, donde se consagre el
eximir del pago de pensiones alimenticias aquellas personas obligadas que
sean doblemente vulnerables, en razón, de recursos financieros limitados. Es
decir, que esta obligación solidaria y legal sea subrogada y cumplida por el
Estado ecuatoriano mediante un bono solidario. | |

for being part of the Vulnerable Group", is oriented to find a fair and viable
solution that guarantees the rights of the constitutional norm firstly to the minor
with the right to receive food , and secondly, to those obliged to provide food
that are in a position of double vulnerability, therefore, unable to comply with
the imposed obligation of food for their descendants. Problematic evidenced
and verified through doctrinal and legal research, in the same way through field
study; In short, it is imperative that this kind of situation be regulated in article
5, Title V, of the Organic Code for Children and Adolescents, where the
exemption from the payment of alimony is established for those obligated
persons who are doubly vulnerable, due to limited financial resources. That
this solidarity and legal obligation be subrogated and fulfilled by the
Ecuadorian State through a solidarity bond. | |
