| dc.description | Históricamente, el habeas corpus ha sido una forma de principalmente, reponer las
libertades vulneradas por las autoridades y su abuzo de poder en detenciones ilegítimas. Por
tanto, ante estas vulneraciones y sobre todo ante un bien muy apreciado como la libertad, se
origina el habeas corpus como un mecanismo para Reivindicar los derechos vulnerados de las
personas ante una ilegitima Aprehensión. La legislación ecuatoriana señala al habeas corpus
desde La Constitución, con la vigencia de la actual Constitución de la República del Ecuador,
el habeas corpus es el mecanismo más eficaz para atacar las ilegalidades cometidas por
funcionarios encargados de cumplir la Ley, en el procedimiento de Detenciones ilegales o
arbitrarias. | |
