| dc.description | La presente investigación se la realiza para: Establecer la digitalización de los documentos notariales como mecanismo que garantice la conservación de los actos jurídicos, facilitando la búsqueda de los archivos, y permitiendo tener la certeza de la seguridad jurídica al existir los archivos en buen estado. Aplicando una
investigación no experimental, de enfoque cualitativo; con un tipo de investigación explicativa, documental; utilizando los métodos teóricos y empíricos. Mediante el análisis documental se pudo considerar el artículo 19 de la Ley Notarial, y los artículos 4, 6 y 9 del Reglamento del Sistema Notarial Integral de la Función
Judicial, se pudo establecer que no existe la exigencia para la digitalización de los documentos notariales del archivo, tampoco se considera la utilización de un sistema informático para poder realizar la búsqueda. Además se realizó la entrevista a cinco profesionales del derecho, permitiendo conocer que existen deficiencias en la manipulación de los archivos, debido a que hay páginas deterioradas. Como conclusiones se tuvo que existe la necesidad de mejorar el manejo documental de los libros de los archivos para evitar su deterioro, considerándose como propuesta la digitalización de los documentos notariales del archivo desde el año de creación de la notaría, para lo cual se plantea la reforma a la Ley Notarial agregando el artículo 50, literales a, b. | |
