dc.descriptionEl acto administrativo presunto que surge del silencio administrativo debe ser reconocido por la administración y ante terceros, sin embargo, este acto suele no ser reconocido por distintas causas, por esta razón el acto administrativo presunto se lo puede ejecutar en la vía judicial ante el Tribunal Contencioso Administrativo. En la presente tesis se analizará la naturaleza jurídica del acto administrativo presunto, los derechos inherentes al silencio administrativo, además se estudiará sobre el procedimiento de ejecución en la vía judicial y las posibles medidas sancionatorias en el caso de incumplimiento de la ejecución. La importancia de analizar esta institución jurídica se debe a que el derecho de petición y el deber de responder del estado en el plazo previsto por la ley se encuentran garantizados en la Constitución del Ecuador.
dc.descriptionThe alleged administrative act arising from administrative silence must be recognized by the administration and before third parties, however, this act is usually not recognized for different causes, for this reason the alleged administrative act can be executed judicially before the Administrative Disput Court. In this thesis we will analyze the legal nature of the alleged administrative act, the inherent rights to administrative silence, also we will study the procedure of execution in the judicial and possible sanctions in the case of non-compliance of the execution. The importance of analyzing this legal institution is due to the right of petition and the duty to respond of the state within the period established by law that are guaranteed in the Constitution of Ecuador.
