mediante la utilización de un medio electrónico ya que pueden existir casos que puedan haber vicios del consentimiento que no van a permitir que el contrato se perfeccione; En el Ecuador la ley de comercio electrónico, firmas y mensaje de datos, no tiene una regulación como tal sobre el consentimiento otorgado mediante el uso de un medio electrónico si no que se remite al código de comercio, en el cual el consentimiento se da por la oferta y aceptación, esta forma es válida en los contratos electrónicos, pero hay otras formas de otorgar el consentimiento ya sea por Click and wrap agreements y Browse wrap, lo cual no se encuentra regulado por la legislación ecuatoriana. | |

The electronic contract has the same elements of any contract capacity, consent, object and legal cause. Regarding consent, it is necessary to bear in mind the way in which it is granted through the use of an electronic means, since there may be cases where there may be vices of consent that will not allow the contract to be perfected. In Ecuador the law of electronic commerce, signatures and data message, does not have a regulation as such on the consent granted through the use of an electronic medium, if not it refers to the commercial code, in which the consent is given by the offer and acceptance, this form is valid in electronic contracts,
