| dc.description | The present thesis seeks to provide, through scientific research, a solution to the problem posed, in relation to the increase in suicides worldwide, specifically in which the victims have been influenced to develop autolytic ideas, concluding in taking their own lives. When carrying out this study, it was possible to demonstrate a legal vacuum that verified that the right to life was not protected or protected in its totality by the State, given that the cases of instigation or persuasion to suicide, through psychological, physical abuse or influence of religious beliefs, are not sanctioned by our current legal regulations.
This investigation consists of conceptual referents and doctrinal elements, which have allowed the understanding of the legal problematic and that, as a result of this investigative process, you have allowed to formulate as a proposal, the fact that a person who persuades or instigates another to end their lives, through physical, psychological or religious influences, should be punished with imprisonment of three to five years. | |
| dc.description | La presente tesis busca aportar, a través de una investigación científica, una solución al problema planteado, en relación al incremento de suicidios a nivel mundial, específicamente en los que las víctimas se han visto influenciados para desarrollar ideaciones autolíticas, concluyendo en quitarse la vida. Al realizar este estudio, se pudo evidenciar un vacío legal que verificó como el derecho a la vida no estaba siendo protegido o tutelado en su totalidad por parte del Estado, en vista que los casos de instigación o persuasión al suicidio, mediante maltrato psicológico, físico o influencia de creencias religiosas, no se encuentran sancionados por nuestra normativa legal vigente.
Esta investigación consta de referentes conceptuales y elementos doctrinarios, que han permitido la comprensión de la problemática jurídica y que, siendo resultado de este proceso indagatorio, ha permitido formular como propuesta que se tipifique y penalice como delito el hecho de la persona que persuada o instigue a otra a terminar con su vida, a través de maltrato físico, psicológico o influencias de creencias religiosas, sea sancionada con pena privativa de libertad de tres a cinco años. | |
