| dc.description | The purpose of the research work is focused on an analysis of new forms of infringement of the rights of children and adolescents (cyberbullying or cyberstalking, grooming, sexting and sextorsión), through the use of technological means such as the internet , social networks, cell phone, etc..; and the responsibility of the state and society in finding effectuate the fundamental rights and constitutional guarantees, because of their integral development, since its breaking greatly impinge on the rights under the Constitution and the Treaties and international agreements signed and ratified by our country, under the best interests of children and adolescents in our country. In our state the application of violence or intimidation in relationships is always reprehensible and must be fought by the state, when the victim is a minor, the zeal of the state should be especially intense, first by the special situation vulnerability of children and secondly by the devastating effects in humans occurs in formation using the relationship of violence or intimidation.
Incessant technological advances produce an endless metamorphosis, almost latent, about the society that constantly modulates and profiles in their tastes and choices. Currently, we are facing a global world that can no longer be performed without resorting to another supplementary universe that is cyberspace. Under this concept a new frontier, a new territory that is harboring all information, communications and ideas outlined. The events that take place on the Internet are not happening in countries where participants or servers are physically, but in a virtual space where it projects its true sense.
I believe this new research proposal in our environment, and that, since the new forms of rights violations that are widening in Latin America and especially in Ecuador; is necessary and imperative that an analysis of the legal basis and possible reform proposals seeking enforce constitutional and international guarantees and fundamental rights of children and adolescents is performed | |
| dc.description | El propósito del trabajo investigativo está orientado a realizar un análisis sobre las nuevas formas de vulneración de los derechos de niños, niñas y adolescentes (Ciberbullying o ciberacoso, grooming, sexting y la sextorsión), a través del uso de medios tecnológicos como: el internet, las redes sociales, el teléfono celular, etc.; y la responsabilidad que tiene el Estado y la sociedad en la búsqueda de efectivizar sus derechos fundamentales y garantías constitucionales, en razón de su desarrollo integral, ya que su quebrantamiento vulnerara enormemente los derechos contemplados en la Constitución y en los Tratados y Convenios Internacionales firmados y ratificados por nuestro país, en virtud del interés superior de los niños, niñas y adolescentes de nuestro país. En nuestro Estado la aplicación de la violencia o intimidación en las relaciones humanas es siempre reprobable y debe ser combatida por el Estado, cuando el sujeto pasivo es un menor, el celo del Estado debe ser especialmente intenso, en primer lugar por la situación de especial vulnerabilidad de los menores y en segundo lugar por los devastadores efectos que en seres en proceso de formación produce la utilización como la relación de la violencia o la intimidación.
Los incesantes avances tecnológicos producen una inacabable metamorfosis, casi latente, sobre la sociedad a la que constantemente modula y perfila en sus gustos y opciones. Actualmente, nos hallamos ante un mundo global que ya no puede ser interpretado sin acudir a otro universo complementario que es el ciberespacio. Bajo este concepto se bosqueja una nueva frontera, un nuevo territorio que trata de cobijar todas las informaciones, comunicaciones e ideas. Los acontecimientos que tienen lugar en Internet no están ocurriendo en los países donde los participantes o los servidores se encuentran físicamente, sino en un espacio virtual donde se proyecta su verdadero sentido.
Considero ésta propuesta investigativa nueva en nuestro medio, ya que al tratarse de nuevas formas de vulneración de derechos que se están acentuando en América Latina y de forma especial en el Ecuador; es necesario e imperante que se realice un análisis sobre las bases jurídicas y posibles propuestas de reforma en búsqueda de hacer efectivas las garantías constitucionales e internacionales y los derechos fundamentales de los niños, niñas y adolescentes | |
