ABSTRACT In the following research project, jurisprudence and laws refer to the right to appeal and recourse to higher courts. It is done to determine the provenance and requirements of the doctrinal interpretation of the right of recourse and appeal concerning the competent courts according to their hierarchical level. This leads to a positivist interpretation of legal regulation. The right to appeal fulfills its objective of protecting the individual by creating a recursive mechanism that allows them to appeal to a higher judge to review the previous decision. For this reason, the hierarchical level of the bodies competent to give answers in the first instance must be taken into account. Also, to ensure compliance with internationally enshrined rights, it is not only necessary that they be established in a norm but also that they be effectively enforceable to generate legal certainty. The right to recourse presupposes that the alternative is ordinary, practical, accessible, with full review and that the minimum guarantees of due process are respected. To ensure that these requirements are met, the appeal must be heard by a higher court in the hierarchy of the State's appeal system. In this way, the higher court's decision is guaranteed to be different from that of the court that issued the first sentence. This decision is based because it respects constitutional rights and those established by international instruments.

En el presente trabajo de investigación, se evalúa la jurisprudencia y las leyes que se refieren al derecho de apelar y recurrir a tribunales superiores. Esto se hace para determinar la procedencia y los requisitos de la interpretación doctrinaria del derecho de recurso y la apelación con respecto a los tribunales competentes según su nivel jerárquico. Esto lleva a una interpretación positivista de la normativa legal. El derecho a recurrir cumple con su objetivo de brindar protección al individuo al crear un mecanismo recursivo que le permita recurrir a un juez superior para examinar la decisión previa. Por ello, se debe tener en cuenta el nivel jerárquico de los órganos competentes para dar respuestas en primera instancia. Además, para garantizar el cumplimiento de los derechos internacionalmente consagrados, no sólo es necesario que se establezcan en una norma, sino que también sean eficazmente aplicables para generar seguridad jurídica. El derecho de recurrir supone que el recurso sea ordinario, eficaz, accesible, con un examen íntegro y que se respeten las garantías mínimas del debido proceso. Para garantizar el cumplimiento de estos presupuestos, el recurso debe ser conocido por un tribunal superior en la jerarquía del sistema recursivo del Estado. De esta manera, se garantiza que la decisión del tribunal superior sea diferente a la del tribunal que dictó la primera sentencia, y que esta decisión se fundamente en motivos que respeten los derechos constitucionales y los establecidos por los instrumentos internacionales. | |
