| dc.description | La retasa de los bienes en los remates es un mecanismo mediante el cual el accionante solicita al juzgador la realización de un nuevo avalúo cuando durante el primer, segundo o tercer señalamiento efectuado en el Sistema de Remates Judiciales en línea no existieron postores, para que proceda la retasa es necesario que la causa se encuentre en la fase de ejecución y que el demandado sea propietario de bienes.
La palabra retasa significa reducir, disminuir el avaluó principal o inicial a fin de que existan nuevos interesados, pues no es lo mismo cancelar seis mil dólares que tres mil dólares por la adjudicación del mismo bien, por otra parte, el ejecutado está investido de derechos, entre ellos el derecho a la defensa, se debe considerar de que no todos formarán parte de la contienda legal, aunque estén legalmente citados, sin embargo, ante la oposición de cumplir con lo pactado los bienes del ejecutado ingresa a la fase de ejecución forzosa, concluyendo con el remate y en algunos casos con la retasa.
El Artículo. 405 del Código Orgánico General de Procesos no determina el límite a reducir, es decir, con o sin la presencia del ejecutado el avalúo será disminuido, pero con su comparecencia podrá suspender la retasa cancelando la obligación dispuesta en el mandamiento de ejecución u oponerse al avalúo comercial para una mejor valoración; el perito de acuerdo a su subjetividad y conocimientos le otorgará un nuevo valor al bien embargado. | |
