| dc.description | Este estudo tem como objetivo final a análise do interesse recursal notadamente sob a ótica do acusado, analisando-se se é possível falar-se em interesse de recorrer da sentença absolutória ou que declara extinta a punibilidade. Para tanto, parte-se de uma análise da origem do problema, ou seja, as condições da ação penal, comparativamente às condições da ação civil. Em seguida, far-se-á a projeção destas condições nos requisitos de admissibilidade dos recursos, focando-se no interesse recursal. Com base nessas premissas, será estudada a sentença penal e o recurso de apelação, para, ao final, especificamente verificar o interesse que possui o réu de apelar de uma sentença que o absolva. | |
| dc.description | This study aims to final appellate review of interest especially from the perspective of the accused, analyzing whether it is possible to speak of interest to appeal the acquittal or finding extinct criminality. To do so, it starts with an analysis of the origin of the problem, it means, the conditions for prosecution, compared to the conditions of civil action. Then far will the projection of these conditions on the requirements for admissibility of actions, focusing on appellate interest. Based on these premises, we will study the criminal sentencing and appeal, for in the end, specifically to verify the interest that has the defendant to appeal a ruling that absolves. | |
