Este trabalho tem o intuito de analisar a questão do controle efetuado pelo juiz quando da prisão em flagrante. Para tanto, far-se-á uma breve análise das prisões em geral, focalizando na prisão em flagrante, observando seus fundamentos de legitimidade e hipóteses de cabimento. Com base nesses conceitos, será debatida a análise feita pelo magistrado da constitucionalidade/legalidade da prisão em flagrante, bem como a investigação da necessidade de manutenção da privação de liberdade através de uma prisão preventiva. Para completar o estudo, serão observadas jurisprudências recentes dos mais altos Tribunais, a fim de constatar a aplicação desses critérios.The aim of this study is to discuss the control that it‟s done by the judge when concerning the citizen‟s arrest. Therefore, it will be done a brief analysis of the arrests in general, focusing in the citizen‟s arrest, its legitimacy basis and suitability hypothesis. Based on these concepts, the judgment about the legality of the citizen‟s arrest done by the magistrate will be debated, as well as the necessity of maintenance of the restriction of freedom through a provisional arrest. To complete the study, recent jurisprudence of the highest Courts will be considered, in order to observe the application of these criteria.
