dc.descriptionEcuadorian legislation is guaranteeing due process in which rights and obligations are determined, which ensure guarantees to the inhabitants, particularly the rights of the parties in cases of intrafamily violence. It considers how the non-appearance of the legal medical expert in domestic violence trials violates the Constitutional principle of Due Process. The research modality will be under a mixed approach, that is, qualitative and quantitative, the type of research is descriptive, field and exegetical, after having executed the techniques and instruments in the research, I find that the majority of the lawyers surveyed agree that the appearance of the Legal Medical Expert in trials of violence within the family is relevant and transcendental to issue a correct resolution.
dc.descriptionLa legislación ecuatoriana está garantizando el debido proceso en el que se determinan derechos y obligaciones, que aseguran a los habitantes y ciudadanas garantías particularmente los derechos de las partes en los casos de violencia intrafamiliar. Se plantea cómo la no comparecencia del perito médico legal en los juicios de violencia intrafamiliar quebranta el principio Constitucional del Debido Proceso. La modalidad de investigación será bajo un enfoque mixto, es decir cualitativo y el cuantitativo, el tipo de investigación es descriptiva, de campo y exegético, después de haber ejecutado las técnicas e instrumentos en la investigación arrojo como resultado que la mayoría de los abogados encuestados coinciden que la comparecencia del Perito Médico Legal en los juicios de violencia dentro de la familia es de relevancia y transcendental para dictar una resolución acertada.
