| dc.description | In Ecuador, there is not enough research about a legal institution that was included in its 2008’s Constitution: the right of resistance. This right has been misinterpreted because, on one hand, its wrong way of exercising it against certain power, and, in the other hand, because it has been incorrectly judged and controlled by that same power; both situations show the importance of defining its basis, object, subjects, and implications in the national and international legal system in order to avoid confusion with other legal institutions, in particular those of the criminal law. Thus, the study of the elements of the right of resistance will define the scope and limits in its exercise in Ecuador. | |
| dc.description | En el Ecuador poco se ha analizado respecto a una institución que se consagró en su Constitución del año 2008. Se trata del derecho a la resistencia, un derecho que ha intentado, por una parte, ser ejercido contra el poder y, por otra, juzgado y controlado por el mismo, en ambos casos evidenciándose la necesidad de determinar su fundamento, objeto, titularidad e implicaciones en el contexto jurídico nacional e internacional para no confundirlo con otras instituciones jurídica, especialmente aquellas del ámbito penal con las que ha sido reprimido. De esta forma, el estudio de los elementos del derecho a la resistencia permitirá definir su alcance y límites al ejercerse en el Ecuador a partir de su positivización constitucional. | |
