| dc.description | Introduction: Abortion legality is controversial in Latin America for several bioethical reasons. Although positive results have been observed after the legalization of abortion —reducing maternal mortality due to complications of clandestine abortion— there are still points of debate based on different bioethical and legal positions that have not allowed its legality. Methodology: This study is a comprehensive narrative literature review on the bioethical aspects of abortion legislation in Latin America using scientific databases such as PubMed, Cochrane Library, and Science Direct as part of the PRISMA strategy. Results: The bioethical approach in favor of the legalization of abortion is gradualist, which gives the embryo a legal character whose importance depends on its developmental stage; on the contrary, the bioethical approach against it is personification, i.e., it recognizes the embryo as a being and therefore it should enjoy the same rights as a person. Despite the positive effects of legalizing abortion in Latin America (in terms of reducing maternal mortality and the cost of healthcare), there are still doubts about the future of free access. Conclusions: The personhood approach recognizes the human being from fertilization; however, there are situations, such as molar pregnancy and ectopic pregnancy in which it cannot be considered the beginning of life. The impact of legal abortion is positive due to the reduction of legal abortions, lower morbidity and mortality, and the promotion of women’s sexual and reproductive rights. | en-US |
| dc.description | Introducción: La legalidad del aborto es controversial en Latinoamérica desde distintos aspectos bioéticos. A pesar de que se han observado resultados favorables tras la legalización del aborto en relación con la disminución de la mortalidad materna secundaria a las complicaciones del aborto clandestino. Todavía existen puntos de debate basados en diferentes posturas bioéticas y legales que no han permitido su legalidad. Metodología: Es un estudio de revisión bibliográfica tipo narrativa, una revisión amplia de la literatura, sobre los aspectos bioéticos de la legislación del aborto en Latinoamérica en bases de datos científicas, como PubMed, Biblioteca Cochrane, y Science Direct, mediante parte de la estrategia PRISMA. Resultados: El enfoque bioético a favor de la legalización del aborto, es gradualista el cual da al embrión un carácter jurídico cuya importancia depende del grado del término en el que se encuentre, en contraposición el enfoque bioético en contra es personificante, es decir, reconoce al embrión como ser y, por lo tanto, debe gozar de los mismos derechos de una persona. A pesar del impacto beneficioso de la legalidad del aborto en Latinoamérica en la disminución de la mortalidad materna y disminución de costes de atención, todavía se tiene dudas a futuro en relación con el libre acceso. Conclusiones: El enfoque personificante, reconoce al ser humano desde la fecundación, sin embargo, existen situaciones como embarazo molar, ectópico en los que no se puede considerar inicio de la vida. El impacto del aborto legal es positivo desde la disminución de abortos legales, menor morbi mortalidad y ejercicio libre de los derechos sexuales y reproductivos en las mujeres. | es-ES |
