| dc.description | Metal mining in Ecuador is an activity that must be developed under the principles of environmental sustainability, precaution, prevention and efficiency, and as a means of preventing, mitigating, controlling and repairing the environmental impacts associated with it, The mining regulations have provided that in order to execute mining activity its owners must have the favorable Administrative Acts granted previously, these are the environmental permits and water permits provided for in the subparagraphs a) and b) of Article 26 of the Mining Law. The objective of the present investigation is to analyze the compliance and non-compliance with the aforementioned regulations on the part of the holders of Artisanal Mining Permits and of the holders of Concessions under Special Regime of Small Mining that carry out the exploitation of metallic material in the Cuenca city. The research was of a mixed type with emphasis on the quantitative, methods such as inductive-deductive, logical historical, synthetic analytical and comparative law were applied. As a contribution, it was recommended to carry out a Reform to the Mining Law to guarantee compliance with article 26 and determine the sanction in cases of non-compliance. | en-US |
| dc.description | La minería metálica en el Ecuador es una actividad que debe desarrollarse bajo los principios de sostenibilidad ambiental, precaución, prevención y eficiencia, y como medio para prevenir, mitigar, controlar y reparar los impactos ambientales asociados a ella, la normativa minera ha previsto que para ejecutar actividad minera sus titulares deben contar con los Actos Administrativos Previos otorgados favorablemente, estos son los permisos ambientales y permisos de agua previstos en los literales a) y b) del Artículo 26 de la Ley de Minería. El objetivo de la presente investigación es analizar el cumplimiento e incumplimiento a la normativa ya mencionada, por parte de los titulares de Permisos de Minería Artesanal como de los titulares de Concesiones bajo Régimen Especial de Pequeña Minería que realizan explotación de material metálico en el Cantón Cuenca. La investigación fue de tipo mixta con énfasis en lo cuantitativo, se aplicaron métodos como el inductivo-deductivo, histórico lógico, analítico sintético y derecho comparado. Como resultados se determinó un alto porcentaje de incumplimiento a la normativa minera, así como también, la falta de control y vigilancia por parte de las Instituciones Mineras y Ambientales. Como aporte se recomendó realizar una Reforma a la Ley de Minería que permita garantizar el cumplimiento al artículo 26 y determinar la sanción en los casos de incumplimiento. | es-ES |
