| dc.description | This article analyzes the states of exception decreed in Ecuador to face the penitentiarycrisis from a doctrinal and constitutional point of view. Qualitative research with adescriptive approach has been used to develop it, concluding that the President’s decreesregarding the severe domestic unrest in all the penitentiary facilities, according to theConstitutional Court, fulfill the requirements of content and form set out in the LOGJCC.Nonetheless, the solution to the penitentiary crisis does not involve establishingcontinuous states of exception; instead, public policies focused on human rights arenecessary. | en-US |
