dc.descriptionThis essay presents an analysis of the constitutionality filtering carried out by the Constitutional Chamber of the Supreme Court during its almost 30 years of existence to the Labor Code (LC), which dates back 75 years. In spite of the Labor Procedural Reform, which modified this Code in more than one half, its individual substantive part still remains intact. Hence, it is very important to know its future course as marked by said jurisdictional body since its judgments are binding for all citizens. For this purpose, this paper analyzes the judgments (approximately 30) provided by the Center of Jurisprudence of the Constitutional Chamber of the Supreme Court of Justice that have kept several articles of the LC intact in those occasions when they have been challenged of contravening the Constitution of the country, and which have maintained the constitutionality of the regulations under said legal body. Thus, the reader can become aware of the corresponding legal arguments within a framework of legal security and, thus, apply them to professional training and/ or practice.de-DE

dc.descriptionEn el presente ensayo, se pasa a ventilar el filtro de constitucionalidad, que ha realizado la Sala Constitucional de la Corte Suprema, a través de sus casi 30 años de existencia, al Código de Trabajo (CT), que data de 75 años de existencia y que si bien, mediante la Reforma Procesal Laboral, vino a ser modificado en más de la mitad, aún se mantiene incólume en su parte sustantiva individual. De ahí la relevancia de tener conocimiento del derrotero, que ha marcado, dicho ente jurisdiccional, al ser sus fallos, de acatamiento obligatorio para la ciudadanía. Para ello, se analizan los fallos (aproximadamente 30) -facilitados por el Centro de Jurisprudencia de la Sala Constitucional de la Corte Suprema de Justicia, que han mantenido indemne los distintos artículos del CT, cuando han sido acusados de contraventores a la Constitución Política del paísque han sostenido la constitucionalidad de la normativa dicho cuerpo legal, con el fin de que el lector, conozca la argumentación jurídica correspondiente, dentro de un marco de seguridad jurídica y pueda así, aplicar la misma, en la formación y/o en la práctica profesional.es-ES
