dc.descriptionThe Costa Rican constitutional doctrine and jurisprudence conceptualize architectural heritage as part of the fundamental right to a healthy and ecologically balanced environment. Based on the idea of protecting the scenic beauty covers, and consequently, the natural beauty (“the green”) and urban beauty (“the gray”), the environmental principles apply to the declaration and control of architectural heritage. Act 7555 provides the competence of the Central Administration for such declaration and control; however, the regulations of other laws allow the argument that local government –municipalities– can perform such activities, thus expanding the recognition of municipal autonomy in the field the real estate system.en-US
dc.descriptionLa doctrina y jurisprudencia constitucional costarricenses conceptúan el patrimonio histórico arquitectónico como parte del derecho fundamental a un ambiente sano y ecológicamente equilibrado. La idea de la protección de las bellezas escénicas abarca, por ende, las bellezas naturales (“lo verde”) y las urbanas (“lo gris”), por lo que los principios iusambientales son aplicables a la declaratoria y control del patrimonio histórico arquitectónico. La Ley 7555 establece una competencia a la Administración Central para tales declaratoria y fiscalización, sin embargo, las regulaciones de otras leyes posibilitan la tesis de que la Administración local –Municipalidades– realicen tales actividades, ampliando así el reconocimiento de una autonomía municipal en el ámbito del ordenamiento inmobiliario.es-ES
