| dc.description | Within the relevant debate whether the punitive role in civil liability applies, in particular, in damages regarding non-pecuniary loss, this research sought to understand the qualities, purposes and differences amongst the punitive damages, which are most mentioned in case-law, intending to underlie the punitive role in awarding damages; the aggravated damages, a close institute, of compensatory role that states the disapproval of a conduct, typical of English Law, also belonging in the Common Law; and the damages with the punitive element that is, in fact, awarded in Brazilian Law. | |
