| dc.description | El estudio parte de la idea de que en el estadio actual del Estado democrático de Derecho, la realización de la transparencia administrativa es un deber de la Administración Pública, porque resulta de un derecho fundamental a la “buena Administración”, bien como del derecho de acceso a la información pública. Por eso, la Administración tiene el deber jurídico de adoptar los instrumentos que hagan su actividad más transparente y accesible. Internet es un instrumento más eficaz en la divulgación que los medios de comunicación convencionales, en virtud de alcanzar más personas, de forma más rápida y por presentar menor costo, además de ser más ecológico. Se concluye que el deber de la Administración Pública de usar internet para cumplir la transparencia es de orden vinculada y no discrecional, pues la realidad de la sociedad de la información no nos deja margen de apreciación para elegir los medios tradicionales de divulgación. | |
| dc.description | The study departs from the idea that at this stage of the democratic state of law, the actualization of administrative transparency is the duty of the public administration, because it is a fundamental right to "good administration", as well as the right of access to public information. Therefore, the Admin- istration has the legal duty to adopt the tools that make its activity more transparent and accessible. Internet is a more effective tool in spreading the conventional media, by reaching more people, faster and lower cost, in addition to being greener. We conclude that the duty of the Public Administration to use the internet to meet the transparency is of linked and non-discretionary order, as the reality of the information society does not leave discretion to choose the traditional means of dissemination. | |
