| dc.description | RESUMO A presente monografia tem por objeto o estudo da responsabilidade civil das instituições financeiras diante de danos ambientais causados por empreendimentos por elas financiados. A pesquisa foi elaborada a partir da análise da doutrina e legislação pertinente à matéria. Além disso, em razão da especificidade do tema e de seus reflexos práticos, examinou-se também o surgimento de iniciativas das instituições financeiras nacionais e internacionais a fim atenderem ao espírito do comando constitucional de preservação do meio ambiente. Como resultado da pesquisa pôde-se concluir que as instituições financeiras, enquanto possíveis poluidores indiretos, têm importante e inafastável responsabilidade no que tange à preservação do meio ambiente saudável e equilibrado, tanto para as presentes quanto para as futuras gerações. Para concretizar esta obrigação, a responsabilidade civil ambiental deve utilizar-se de um raciocínio que garanta que as instituições financeiras tenham como finalidade principal na concessão de um financiamento a adoção de medidas preventivas, diminuindo consideravelmente a ocorrência de riscos e danos ao meio ambiente. A responsabilidade civil ambiental pela teoria do risco criado é, assim, um desses instrumentos, vez que admite excludentes de responsabilidade. Outrossim, a adoção de medidas preventivas evita que se configure o nexo causal, estimulando sobremaneira sua adoção, sob pena de o agente financiador enquadrar-se na categoria de poluidor indireto e responder solidariamente pelo danos causados ao meio ambiente pelos empreendimentos por ele financiados. | |
| dc.description | ABSTRACT The object of this essay is the study of civil liability of financial institutions on the environmental damage caused by projects financed by them. The survey was drawn from the analysis of doctrine and legislation concerning this matter. Moreover, because of the specificity of the subject and its practical consequences, was also examined the emergence of national and international financial institutions’ initiatives to meet the spirit of the constitutional command of preserving the environment. As a result of the study it was concluded that the financial institutions, as possible indirect polluters, have important and unremovable responsibility regarding the preservation of the healthy and balanced environment, both for present and for future generations. To fulfill this obligation, environmental liability should be used as an argument to ensure that financial institutions have as their main purpose the provision of financing the adoption of preventive measures, significantly reducing the occurrence of risks and damage to the environment. The environmental liability by the risk created theory is one of these instruments, as it acknowledges means that exclude responsibility. Furthermore, the adoption of preventive measures avoids the configuration of the bond between action and damage, greatly stimulating its adoption, otherwise the funder is inserted in the category of indirect polluter, being jointly responsible for the damage caused to the environment by the projects it finances. | |
