| dc.description | The present work lends itself to analyze the basic concepts about public health surveillance in the national territory, as well as the legislative references that say about the matter. Then, the main characteristics of the police power will be examined together with its legal provisions. To achieve this goal, a bibliographic and qualitative research was carried out, by consulting the studies that were used to analyze the theme. In this context, it will remain clear that the performance of the Public Power with a counterprestational bias often does not serve the best interest of the private individual, lacking the Brazilian legal scenario of an effective inspection regarding the performance of the police power, thus requiring a jurisprudential and practical reanalysis. | en-US |
| dc.description | O presente trabalho presta-se a analisar os conceitos básicos sobre a vigilância sanitária no território nacional, assim como também as referências legislativas que dizem a respeito da matéria. Seguidamente, serão examinadas as características precípuas do poder de polícia conjuntamente com seus dispositivos legais. Para alcançar esse objetivo, foi realizada uma pesquisa bibliográfica e qualitativa, mediante consulta aos estudos que se prestaram a analisar o tema. Nesse contexto, restará explicitado que a atuação do Poder Público com viés contraprestacional muitas vezes não atende ao melhor interesse do particular, carecendo o cenário jurídico brasileiro de uma fiscalização efetiva quanto à atuação do poder de polícia, necessitando, assim, de uma reanálise jurisprudencial e prática. | pt-BR |
