dc.descriptionthe present work has as problem of the research: to analyze the effectiveness of the rights of the elderly in Brazil, having as base the protection to the elderly after the Federal Constitution of 1988, regulated infra constitutionally by the Laws of the National Policy of the Elderly - PNI (Law 8.482/94) and the Statute of the Elderly (Law 10.471/03). We analyzed the evolution of the guardianship of the elderly in the main codes of the Brazilian order, with the purpose of thinking possible solutions that would depend on the filling of gaps in the current order. Using the inductive method, it is a bibliographic research of scientific documents, in addition to the analysis of legislation and data statistics from the tables of the Brazilian Institute of Geography and Statistics (IBGE). After the research, it was found that Brazil has a wide range of regulations, which aims to protect the elderly, however, the biggest challenge today is the effectiveness of these rights by the public power and society in general.en-US
dc.descriptionO presente trabalho tem como objetivo analisar a efetividade dos direitos dos idosos no Brasil, tendo como base a Constituição Federal de 1988, a Lei da Política Nacional do Idoso – PNI (Lei Nº 8.482/94) e o Estatuto do Idoso (Lei Nº 10.471/03), além de analisar a evolução da tutela ao idoso nos principais códigos do ordenamento brasileiro. Trata-se de uma pesquisa bibliográfica de documentos científicos, além da análise da legislação e estatística de dados das tabelas do Instituto Brasileiro de Geografia e Estatística (IBGE). Após a pesquisa, constatou-se que o Brasil possui uma vasta gama normativa, a qual visa à proteção do idoso, entretanto, o maior desafio hoje é a efetividade desses direitos pelo poder público e pela sociedade em geral.pt-BR
