dc.descriptionThe case Olmedo Bustos against Chile, also known as “The Last Temptation of Christ Case”, is an outstanding case in terms of the right to freedom of expression, mainly around art. The famous case established the bases regarding the prohibition of prior censorship and condemned the Chilean State for establishing the possibility of it in its National Constitution. Little more than twenty years after that pronouncement, reality has changed a lot. The films went from being shown in theaters to being broadcast live on digital platforms; viewers have access to many more artistic expressions from around the world because of globalization; and, due to the reduction of costs in digital filming, any citizen can communicate their ideas to thousands of people through social networks. Added to this, the former owners of the space for social expression have begun to change their practices, entering into brutal competition with newcomers (digital media) to get our attention. In this context, in which social media have become digital public squares, in which art has been democratized to a great extent and information is distributed almost instantly, I propose to analyze the guidelines of the leading case, and search among its components a map of its applicability to these new contexts; the objective being to anticipate future cases that the Inter-American Court of Human Rights (IACHR) will have to deal with very briefly.en-US
dc.descriptionEl Caso Olmedo Bustos contra Chile, también conocido como “La Última Tentación de Cristo”, es un leading case en materia de derecho a la libertad de expresión, principalmente en torno al arte. El mencionado caso estableció las bases respecto a la prohibición de la censura previa y condenó al Estado chileno por establecer la posibilidad de la misma en su Carta Magna. Poco más de veinte años desde aquel pronunciamiento, la realidad social de la industria cinematográfica ha cambiado bastante. Las proyecciones en salas viraron a las trasmisiones en vivo por plataformas digitales; los espectadores tienen acceso a más canales de difusión de expresiones artísticas como consecuencia de la globalización; y la reducción de los costes en la filmación digital, ha facilitado la comunicación para cualquier ciudadano. Sumado a esto, los monopolios del espacio de expresión social, han empezado a modificar sus prácticas, compitiendo con los recién llegados, es decir los medios digitales, para llamar nuestra atención. En este contexto, en el que las redes se han vuelto plazas públicas digitales, en las que el arte se ha democratizado en gran medida y la información se distribuye casi al instante, se analizarán los lineamientos del leading case, con el propósito de hallar entre sus componentes un mapa de su aplicabilidad a estos nuevos contextos; siendo el objetivo anticiparnos a los futuros casos que la Corte Interamericana de Derechos Humanos (CIDH) tendrá que tratar con suma brevedad.es-ES
