La declaración notarial de la paternidad extramatrimonial de menor de edad

Abstract

La presente tesis titulada: “La Declaración Notarial de la Paternidad Extramatrimonial de menor de edad.” tiene como propósito, demostrar la necesidad en incorporar un procedimiento –nuevo- no contencioso de aplicación en sede notarial, referida a la declaración de paternidad extramatrimonial. Es por ello que para cumplir con el propósito de la investigación, se estudiará todo lo relacionado al Proceso de Filiación y los Procesos no Contenciosos, lo cual facilitará y ayudará a establecer la importancia de la incorporación de una nueva atención notarial sobre asunto no contencioso relacionado a la declaración de paternidad extramatrimonial, pero siempre salvaguardando el Principio del Interés Superior de Niño, de tal manera dicho proceso se lleve a cabo con prontitud, celeridad procedimental, eficacia y sobre todo seguridad jurídica, características principales de las actuaciones notariales. Después de una minuciosa investigación se concluye que es conveniente para el ciudadano en particular, la sociedad, y el Estado Peruano, que en sede notarial se tramite como asunto no contencioso el procedimiento de reconocimiento y declaración de paternidad de hijo extramatrimonial.

This thesis entitled: "The Notarial Declaration of Extramarital Paternity of Minors." Its purpose is to demonstrate the need to incorporate a new non-contentious process of notarial competence to declare extramarital paternity. That is why, in order to fulfill the purpose of the investigation, everything related to the Affiliation Process and the Non-Contentious Processes will be studied, which will facilitate and help to establish the importance of incorporating a new non-contentious notarial process regarding the declaration of extramarital paternity, but always safeguarding the Principle of the Higher Interest of the Child, in such a way that said process is carried out with promptness, procedural speed, efficiency and above all legal security, main characteristics of the notarial actions. After a thorough investigation it is concluded that it is convenient for the State, for society and the interested parties that the process of recognition of paternity of an extramarital child be carried out before a notary.
