La trata de personas menores de edad y la cámara Gesell en la investigación preliminar e intermedia

Abstract

El presente trabajo de investigación se refiere al problema de la trata de personas de manera general y particularmente de la trata de menores, especialmente en el escenario nacional, en las zonas del Perú, donde este delito se mantiene latente en las regiones como Lima, Madre de Dios, Puno, Arequipa y otros lugares donde particularmente, el abuso de los menores de edad es una actividad casi habitual de personas inescrupulosas.

Al estar los menores comprometidos por estas personas, abusan de ellos, por lo que se hace necesario que, en el momento oportuno, tengan que declarar ante las autoridades correspondientes en calidad de afectados o agraviados y testigos de los hechos. Muchas veces los menores son re victimizados (victimización secundaria) porque tienen que repetir la misma historia ante la Policía Nacional, Ministerio Público y Poder Judicial. No se considera que tantas otras veces describen lo mismo ante sus familiares, psicólogos, asistentas sociales ú otras personas.

Por tanto, el objetivo es vincular estas circunstancias para poder viabilizar a las víctimas menores de la trata de personas y sus declaraciones testimoniales, buscando evitar la re victimización, empleando aparte de la teoría y la doctrina, los instrumentos metodológicos y la tecnología, para contribuir a una mejor solución en la salud física y mental de los menores afectados.

This research work deals with the problem of human trafficking in a general way and particularly with the trafficking of minors, especially in the national scenario, in the areas of Peru, where this crime remains latent in regions such as Lima, Madre de Dios, Puno, Arequipa and other places where, in particular, the abuse of minors is an almost habitual activity of unscrupulous people.

As the minors are compromised by these people, they abuse them, it is necessary that, at the appropriate time, they have to make a statement before the corresponding authorities as affected persons and witnesses to the events. Often times minors are re-victimized (secondary victimization) because they have to repeat the same story before the National Police, the Public Ministry and the Judiciary. It is not considered that so many times they describe the same thing to their relatives, psychologists, social workers or other people.

Therefore, the objective is to link these circumstances in order to enable minor victims of human trafficking and their testimonial statements, seeking avoid re-victimization, using apart from theory and doctrine, methodological instruments and technology, to contribute to a better solution in the physical and mental health of the minors affected.
