CONTENCIOSO ADMINISTRATIVO

Abstract

Se contesta la demanda por parte de la Procuraduría Pública de la Municipalidad del Callao, NEGÁNDOLA Y CONTRADICIÉNDOLA EN TODOS SUS EXTREMOS. Fundamentos de Hecho: 1°La boleta de pago se encuentra inmersa en la escala de servidores beneficiados por el Decreto Supremo 019-94-PCM, y por ello ha sido otorgada debidamente. 2°Al haber percibido aumentos por D.S. 019-94-PCM, no le corresponde percibir los beneficios del N° 037-94-PCM, HABIENDO LA AUTORIDAD ADMINISTRATIVA CUMPLIDO CON EL DECRETO LEGISLATIVO N°847. 3°En cuanto al Fundamento 14, DE LA SENTENCIA RECAIDA EN LA ACCIÓN DE CUMPLIMIENTO, EXP 2616-2004-AC/TC, se refiere a cuestiones judiciales o jurisdiccionales, pero no actos administrativos.
