La pensión de viudez por reconocimiento de unión de hecho en la dirección de pensiones de la Policia Nacional del Perú

Abstract

Teniendo en cuenta que la pensión de viudez consiste en el pago mensual a favor de las viudas, ya sean derivadas por la unión matrimonial o por unión de hecho. No obstante, la Dirección de Pensiones de la Policía Nacional del Perú vulnera el derecho de pensión de viudez derivada por reconocimiento judicial o notarial de unión de hecho, en aplicación del Régimen de Pensiones Militar Policial, la misma que no protege el derecho de pensión de viudez para los sobrevivientes derivadas por declaración de reconocimiento de unión de hecho en el Poder Judicial o en la sede Notarial, por consiguiente los derechos fundamentales de los sobrevivientes viudas son vulnerados por el Régimen Militar - Policial con respecto al otorgamiento de pensiones a las viudas.

Taking into account that the widow's pension consists of the monthly payment in favor of widows, whether they are derived by marriage or by de facto union. However, the Pensions Directorate of the Polices of the National Police of Peru violates the right of pension of widowhood derived by judicial or notarial recognition of de facto union, in application of the Military Police pension system, the same that does not protect the right of widow's pension for the survivors derived by declaration of recognition of de facto union in the Judicial Power or in the Notarial office, therefore the fundamental rights of the widowed survivors are violated by the Military-Police Regime with respect to the granting of pensions to the widows.
