La responsabilidad civil del peatón que ocasiona un accidente de tránsito siempre y cuando éste no haya resultado con lesiones graves o la muerte

Abstract

En el presente trabajo de investigación, haremos un análisis de la responsabilidad civil, propiamente la extracontractual, y con la información respectiva trataremos de identificar la responsabilidad civil en un accidente de tránsito que es provocado por el peatón. Todos los que conducimos un vehículo tenemos conocimiento de que al hacer uso de este, nos enfrentamos a muchos riesgos, incluido la imprudencia del peatón. Las personas que vivimos en una sociedad tenemos derechos y obligaciones, y que todos somos iguales ante la ley, eso es lo que dice La Constitución y otras normas, en ese entender, tocaremos temas importantes que están dentro de la responsabilidad, como los elementos para que se configure y la víctima pueda pedir una reparación, la subjetividad del agente, la objetividad de los daños, y cómo es que se rompe esta relación entre causa y efecto, en fin, todos estos temas, repito importantes serán abordados y con la amplia información de juristas, como Trazegniec, Osterling, Sessarego, y muchos más. Bajo el Instituto de la responsabilidad civil todas las personas estamos en la obligación de resarcir el daño causado ya sea por dolo o culpa, más no ocurre si un sujeto imprudente en estado ecuánime, en estado de ebriedad o bajo la influencia de drogas provoca un accidente de tránsito y el conductor hace todo lo posible para no atropellarlo, producto de este hecho el vehículo queda dañado, impactar con otro vehículo o vivienda, como también pueden haber lesiones personales, en este caso por lo general la justicia siempre hará responsable al conductor y/o propietario del vehículo y el peatón siempre quedará impune. Por consiguiente la investigación está centrada en ese punto y cuáles son los motivos por los que la legislación es benevolente con el peatón imprudente.

Under the Institute of civil liability, all people are under the obligation to compensate the damage caused either by fraud or fault, but it does not happen if a reckless subject in a fair state, in a state of drunkenness or under the influence of drugs causes an accident of traffic and the driver does everything possible not to run over him, as a result of this fact the vehicle is damaged, impact with another vehicle or home, as well as there may be personal injuries, in this case usually the justice will always hold the driver responsible and / or owner of the vehicle and the pedestrian will always go unpunished. Therefore the investigation is focused on that point and what are the reasons why the legislation is kind to the reckless pedestrian.
