Factores que impiden se lleve a cabo una debida diligencia en el procedimiento para la investigación del delito de trata de personas en el distrito de San Jerónimo de la ciudad de Cusco, 2018-2019

Abstract

La presente tesis desarrolla los factores que impiden se lleve a cabo una debida diligencia en el procedimiento para la investigación del delito de trata de personas; investigación que se realizó en el Distrito de San Jerónimo, ya que se ha verificado que en este Distrito existe una alta tasa de incidencia del delito de trata de personas bajo la modalidad o fin de explotación laboral; investigación que parte de la verificación de la información bibliográfica, así como la de fuente policial y fiscal, lo que ha permitido determinar la existencia de factores tanto personales como institucionales que impiden se lleve a cabo la investigación y se torne este en un delito impune. Por otro lado, se ha verificado que en el ámbito policial existen diligencias que no son llevadas a cabo en la investigación del delito de trata de personas, lo que conducen a que esta tienda a fracasar o que en su defecto no se judicialice; y por último se dará a conocer los fines más utilizados del delito de trata de personas en la ciudad de Cusco.

This thesis develops the factors that prevent a due diligence from being carried out in the procedure for the investigation of the crime of trafficking in persons; investigation that was carried out in the District of San Jerónimo, since it has been verified that in this District there is a high incidence rate of the crime of trafficking in persons under the modality or purpose of labor exploitation; An investigation that starts from the verification of bibliographic information, as well as that of police and prosecutorial sources, which has made it possible to determine the existence of both personal and institutional factors that prevent the investigation from being carried out and it becomes an unpunished crime. On the other hand, it has been verified that in the police field there are procedures that are not carried out in the investigation of the crime of human trafficking, which leads to this store to fail or, failing that, it is not prosecuted; and finally, the most used purposes of the crime of human trafficking in the city of Cusco will be announced.
