La ineficacia de la notificación en el procedimiento administrativo sancionador para el fortalecimiento de las acciones de control y vigilancia forestal y fauna silvestre en Madre de Dios.

Abstract

El problema general de la presente investigación, fue analizar si las notificaciones dentro de la apertura del procedimiento administrativo sancionador, dirigido por la Gerencia Regional Forestal de Fauna Silvestre de Madre de Dios son eficaces durante el año 2021, y el objetivo el determinar la eficacia de las notificaciones dentro del procedimiento administrativo sancionador, con la elaboración de un tipo de investigación descriptiva básica con un diseño metodológico cualitativo en la medida que se busca describir y entender el fenómeno de estudio basándose en la recolección de información y el análisis de los procedimientos administrativos sancionadores, iniciados durante el año 2021 por la oficina del área de sanciones de la Gerencia Regional Forestal de Fauna Silvestre de Madre de Dios. La conclusión que se obtuvo de la investigación fue que se viene incumpliendo con el proceso de notificación mostrando señales de ineficacia de la misma, en los procedimientos llevados en contra de los administrados, por la Gerencia Regional Forestal de Fauna Silvestre puesto que se evidencio que no cumple con las formalidades y la entrega de las notificaciones de acuerdo a la norma establecida dentro de la Ley de procedimientos administrativo general N° 27444.

The general problem of this research was to analyze if the notifications within the opening of the administrative sanctioning procedure, directed by the Regional Forestry and Wildlife Management of Madre de Dios are effective during the year 2021, and the objective was to determine the effectiveness of the notifications within the administrative sanctioning procedure, with the elaboration of a basic descriptive type of research with a qualitative methodological design insofar as it seeks to describe and understand the study phenomenon based on the collection of information and the analysis of the administrative sanctioning procedures initiated during the year 2021 by the sanctions area office of the Regional Forestry Wildlife Management of Madre de Dios. The conclusion obtained from the investigation was that the notification process is not being complied with, showing signs of inefficiency in the procedures carried out by the Regional Forestry and Wildlife Management Office against the administrated parties, since it was evidenced that it does not comply with the formalities and the delivery of the notifications according to the norms established within the Law of General Administrative Procedures N° 27444.
