Informe de trabajo académico: expediente civil: petición de herencia y expediente penal: robo agravado

Abstract

El presente informe académico se realizó un estudio de investigación y análisis de un expediente judicial especifico en materia de Acción de Petición de Herencia, el cual está regulado en el C.C en el art. 664°, en el cual refiere que la acción de petición de herencia corresponde al heredero que no posee los bienes que considere que le pertenecen, y se dirige contra quienes lo posea en todo o en parte a título sucesorio, para excluirlo o concurrir con él. Por otro lado, el presente informe consta de V capítulos: Capitulo I. Resumen del Caso; Capitulo II, Análisis del caso; Capitulo III, Marco teórico, Capitulo IV, Jurisprudencia; y capítulo V, Conclusiones.

This academic report was carried out an investigation study and analysis of a specific judicial file regarding the Inheritance Petition Action, which is regulated in the C.C in art. 664 °, in which it refers that the inheritance petition action corresponds to the heir who does not own the assets that he considers to belong to him, and is directed against those who possess it in whole or in part by way of succession, to exclude it or concur with it. On the other hand, this report consists of V chapters: Chapter I. Summary of the Case; Chapter II, Analysis of the case; Chapter III, Theoretical framework, Chapter IV, Jurisprudence; and Chapter V, Conclusions.
