Necesidad de investigar rigurosamente el monto de los ingresos del que debe prestar alimentos (Propuesta Legislativa)

Abstract

El presente trabajo de investigación “NECESIDAD DE INVESTIGAR

RIGUROSAMENTE EL MONTO DE LOS INGRESOS DEL QUE DEBE PRESTAR ALIMENTOS”, surge en bases a la problemática jurídico-social en los casos de procesos en materia de alimentos en todas las Cortes de Justicia de nuestro país, siendo uno de los procedimientos más notables e importantes en el Poder Judicial; que sin duda constituye un problema de índole social y jurídica que afecta un legítimo derecho de toda persona. En el Capítulo I, de esta tesis desarrolla el problema y los aspectos metodológicos del estudio que se aborda en la presente investigación; asimismo la Justificación, hipótesis de trabajo y categorías de estudio. En el Capítulo II: Desarrollo temático, dividido en Sub-Capitulo I. Marco jurídico- civil del derecho de alimentos. En el Sub-Capitulo II: Tratamiento jurídico-civil de la obligación y de los criterios para fijar alimentos, Antecedentes, La obligación de Alimentos, Características de la Obligación alimentaria; y en el Sub-Capitulo III: Proceso de alimentos. En el Capítulo III: Resultados y análisis de los hallazgos, Resultados del Estudio, Análisis de los hallazgos, Discusión y contrastación teórica de los hallazgos de la presente investigación de los criterios para fijar alimentos y la necesidad de investigar rigurosamente el monto de los ingresos del obligado a prestar alimentos.

The present research work “NEED TO RIGOROUSLY INVESTIGATE THE INCOME OF THE INCOME TO BE FOOD“, arises on the basis of the legal-social issue in the cases of food processes in all the Courts of Justice of our country, being one of the most remarkable and important procedures in the Judiciary; which is undoubtedly a social and legal problem affecting a legitimate right of every person.

In Chapter I, this thesis develops the problem and methodological aspects of the study addressed in this research; Justification, working hypotheses and study categories. In Chapter II: Thematic Development, divided into Sub-Chapter I. Legal-Civil Framework for Food Law. In Sub-Chapter II: Legal-Civil Treatment of The Obligation and Criteria for Fixing Food, Background, Food Obligation, Characteristics of Food Obligation; and in Sub-Chapter III: Food Process. In Chapter III: Results and Analysis of The Findings, Study Results, Analysis of Findings, Discussion and Theoretical Contrast of The Findings of this Research of Criteria for Fixing Food and the Need to Rigorously Investigate the Amount of Income of the Person Forced to Provide Food.
