dc.description.abstractCustoms violations are the result of the need to control international trade, thus Ecuadorian legislation recognizes two ways in which behaviors contrary to current regulations are sanctioned, administrative and criminal. The first is the result of the sanctioning summaries applied by the Customs Administration, which only requires the transgression of the rule, unlike criminal proceedings, which requires proof of materiality and responsibility in the commission of the crime, including guilt. This is how it is visualized through this adequate research work are the principles applied in criminal matters, which must be replicated in administrative headquarters in order to guarantee the right to defense and due process. The need to appoint specialist judges in the matter is verified to guarantee better resolutions.
