dc.description.abstractIn this work was made the history of the concept and historical evolution of the insurance contract, emphasizing the insurance people, with their typical characteristics. Based on their regulation in the legislation, saw the amplitude and extent of its application in the Civil Code and the conflict on the dockets of the STF and STJ. Finally, the configuration analyzed in the light of the applicability of art.798 of the Civil Code through compliance summaries above.
